These Terms of Use govern your use of the Lost Dutchman Marathon website at lostdutchmanmarathon.org. By using the site you agree to these Terms. If you do not agree, please do not use the site.
1. About this website
This site provides information about the Lost Dutchman Marathon and related running events held near Apache Junction, Arizona. Race registration and payment are completed off-site through our registration partner, Race Roster.
2. Acceptable use
You agree to use the site for lawful purposes only and not to interfere with its operation, attempt unauthorized access, or misuse it. Information on the site (dates, courses, pricing, schedules) may change without notice.
3. Registration, fees, and refunds
Registration is governed by the registration partner's terms and by our Refund & Cancellation Policy. All registration fees are non-refundable and non-deferrable; please review that policy before you register.
4. Participation and assumption of risk
Participation in a marathon or other running event involves inherent physical risks, including the risk of serious injury. You should consult a physician before training or participating. By registering you acknowledge and assume these risks and agree to the liability waiver presented during registration. Race-day instructions and the directions of the race director and event staff must be followed for everyone's safety.
5. Photo and video release
Events are photographed and filmed. By participating or attending, you grant the Lost Dutchman Marathon the right to use your image in event photos and video for promotional and informational purposes, without compensation, except where prohibited by law.
6. Intellectual property
The site and its content (text, graphics, logos, course maps, images) are owned by the Lost Dutchman Marathon or its licensors and are protected by law. You may not copy or reuse them without permission, except as needed to view the site normally.
7. Third-party links and services
The site links to third-party services (for example Race Roster, Athlinks, and sponsors). We are not responsible for the content, policies, or practices of third parties.
8. Disclaimer and limitation of liability
The website and its content are provided "as is" without warranties of any kind. To the fullest extent permitted by law, the Lost Dutchman Marathon is not liable for indirect, incidental, or consequential damages arising from your use of the website. Liability relating to event participation is governed by the registration waiver you accept at sign-up.
9. Governing law and disputes
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Disputes will first be addressed through good-faith informal discussion; unresolved disputes are subject to the state and federal courts located in Arizona.
10. Changes to these Terms
We may update these Terms. Material changes take effect when we post the updated Terms with a new effective date above.
